16 A That’s correct.

17 Q Okay.

18 A — think on the back it has Privacy Act issues, as

19 well.

39 Q There’s nowhere on that working with a brochure —

40 Working with a REALTOR brochure that specifies a

41 particular agency; it’s an explanation of all the

42 agencies, correct? Or three of them, I believe?

43 A Yeah. You’re not — You’re not making a selection

44 particularly at that time. That discussion is

45 suppose to happen before you then get into

46 whatever kind of a contract that you might be

47 engaging in with the client.

24 Q Right. So it doesn’t come in a brochure, but it’s

25 an original document that looks like — it doesn’t

26 look like a brochure, and it’s not blue, —

27 A It’s —

28 Q — correct?

29 A It’s not in brochure form; it’s a one-page form,

30 obviously.

1 Q So you attend their home, they invite you in,

2 obviously, you sit down. And so what’s the first

3 thing you talk about?

4 A Well, basically the first few minutes was just,

5 you know, a generalization.

6 Q Of what?

7 A Well, just, you know, building rapport. You know,

8 how-do-you-dos, type of thing.

2 A The —

3 Q — 178, the — I don’t see anywhere, but you keep

4 calling it Working with a REALTOR.

5 A Yeah. Well, as I said, I believe that was prior

6 to going into the comparable sales. Now, if

7 you’re asking — Like I said, the meeting lasted

8 about two-and-a-quarter to two-and-a-half hours,

9 so if you’re saying, you know, was it half an hour

10 or an hour, I would say probably in the first —

11 first hour.

19 Q Okay. I understand. Nowhere on here did I see

20 that it says that you — that they agree that

21 they’re entering into a dual agency agreement with

22 you, correct? Nothing on this brochure is an

23 acknowledgement of that agency — dual agency

24 agreement with you, correct?

25 A There’s nothing in here that says at that moment

26 in time they’re entering a dual agency. It

27 describes all of the various agencies.

28 Q And what — the acknowledgement on the left-hand

29 side is that they understand that there’s multiple

30 agency agreements?

31 A They’re — They’re acknowledging that they have

32 read and understand this brochure.

33 Q Okay. Which outlines three different types of

34 agency relationships?

35 A Right.

36 Q Okay. And this was — you went through — Now,

37 you gave them a copy, or gave them another

38 original?

39 A There were two — two versions, which they had one

40 and I kept one.

45 Q And that’s because, as with Ms. Hundley, there was

46 a brochure, you were able to keep the left-hand

47 column, and she was able to keep the other parts?

1 A Yeah. In Mrs. Hundley’s instance, I actually gave

2 her the folded brochure, and she signed the

3 left-hand column and kept the remainder of the

4 brochure.
